data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><em>LLEI 11\/2020, de 18 de setembre, de mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes als contractes d\u2019arrendament d\u2019habitatge i de modificaci\u00f3 de la Llei 18\/2007, de la Llei 24\/2015 i de la Llei 4\/2016, relatives a la protecci\u00f3 del dret a l\u2019habitatge. <\/em><\/p><p>(DOGC 29.09.2020)<\/p><p>La Llei del Parlament de Catalunya que entra en vigor dem\u00e0 dia 22 de setembre, i que estableix limitacions a les rendes de lloguer, s\u2019aplica als arrendaments destinats a resid\u00e8ncia permanent de l\u2019inquil\u00ed i que estiguin ubicats en \u00e0rees declarades de mercat d\u2019habitatge tens, que de manera provisional i fins que els municipis respectius insten aquesta declaraci\u00f3 per a les seves \u00e0rees o transcorri un any, s\u00f3n els que v\u00e9nen detallats a l\u2019annex d\u2019aquesta Llei \u2013 municipis de m\u00e9s de 20.000 habitants, amb increments de renda de m\u00e9s del 20% en els darrers anys o que es troben a l\u2019\u00e0rea metropolitana de Barcelona -.<\/p><p>Queden fora de l\u2019\u00e0mbit de la Llei els contractes d\u2019arrendament subjectes a r\u00e8gims especials de determinaci\u00f3 de renda, els subjectes a pol\u00edtiques p\u00fabliques de car\u00e0cter social o assistencial, aix\u00ed com els subscrits abans del 01\/01\/1995.<\/p><p>La limitaci\u00f3 es concreta a la renda m\u00e0xima que s\u2019obt\u00e9 a trav\u00e9s de l\u2019\u00cdndex de Refer\u00e8ncia de Preus de Lloguer de l\u2019Ag\u00e8ncia de l\u2019Habitatge de Catalunya, per a un immoble de caracter\u00edstiques an\u00e0logues, o la renda que es satisf\u00e0 al contracte de arrendament anterior, degudament actualitzada. Els habitatges de nova construcci\u00f3 o resultants de l\u2019execuci\u00f3 d\u2019una gran rehabilitaci\u00f3 es podran acollir al tram o \u00e0rea superior de l\u2019\u00edndex de refer\u00e8ncia durant els 5 primers anys.<\/p><p>En cas que els ingressos de l\u2019arrendador persona f\u00edsica no superin 2,5 vegades l\u2019indicador de renda de sufici\u00e8ncia de Catalunya, els ingressos de l\u2019inquil\u00ed superin 3,5 vegades l\u2019indicador, i la renda del contracte anterior fos inferior a l\u2019\u00edndex de refer\u00e8ncia. propietari pot augmentar-la fins a igualar aquest \u00cdndex. El propietari pot incrementar la renda per sobre de l\u2019\u00edndex de refer\u00e8ncia en casos molt concrets, si ha realitzat l\u2019\u00faltim any obres de millora a l\u2019habitatge, o si l\u2019habitatge t\u00e9 caracter\u00edstiques especials, com ara zones comunit\u00e0ries, est\u00e0 moblada o t\u00e9 servei de consergeria , entre d\u2019altres, i amb les regles que es descriuen a la Llei.<\/p><p>Tots els increments han de constar especificats i detallats al contracte d\u2019arrendament, i cal annexar-ne la documentaci\u00f3 justificativa, especialment si la renda ve determinada per un contracte d\u2019arrendament anterior. En aquest darrer cas, l\u2019inquil\u00ed t\u00e9 dret a obtenir de l\u2019INCASOL la data i la renda del contracte d\u2019arrendament anterior, tant de manera pr\u00e8via a la signatura del contracte de lloguer, com una vegada formalitzat. El cobrament de quantitats a l\u2019inquil\u00ed que sobrepassin els l\u00edmits que estableix aquesta Llei d\u00f3na dret a l\u2019inquil\u00ed a obtenir la restituci\u00f3 de les quantitats abonades en exc\u00e9s, incrementades amb l\u2019inter\u00e8s legal dels diners m\u00e9s 3 punts addicionals.<\/p><p>Tamb\u00e9 els particulars i les ag\u00e8ncies que facin publicitat d\u2019habitatges per llogar estan obligats a informar de l\u2019aplicaci\u00f3 i del valor que correspongui a la renda segons l\u2019\u00cdndex de Refer\u00e8ncia, i si escau, de l\u2019import de la renda del darrer contracte d\u2019arrendament d\u2019aquesta habitatge, degudament actualitzat. L\u2019incompliment del que estableix aquesta Llei est\u00e0 subjecte al mateix r\u00e8gim sancionador de la Llei del dret a l\u2019habitatge, amb multes que oscil\u00b7len entre 3.000 i 90.000 euros en funci\u00f3 de la gravetat.<\/p><p>Municipis inclosos a la declaraci\u00f3 transit\u00f2ria d\u2019\u00e0rees amb mercat d\u2019habitatge tens<\/p><p>1.
